Rental Agreement, Credit Card Authorization, and Damage Waiver
Reservations for this property are non-refundable, but we offer a cancelation waiver that costs 10% of the gross rental fee and allows you to cancel for any reason within 48 hours prior to the check-in date. This optional waiver can only be purchased at the time of booking. If you purchase the waiver, you must call and email us at least 48 hours before check-in with your notice of cancelation. If you cancel at least 48 hours before check-in and purchased the waiver, we will issue a refund (minus the cost of the waiver) within 5–7 business days. If this waiver was purchased it will show on the reservation breakdown.
Damage Waiver and Capacity Restrictions
Our properties are inspected before and after each reservation. Guests agree to pay for any flagrant damage, excessive cleaning required at check-out, missing or damaged contents, or any other accidental damage during the rental period. Your reservation was either charged $89.00 for a damage waiver to cover up to $1,500.00 in damage or a deposit was collected. If damages exceed coverage, the renter authorizes charges to the credit card on file. Sleeping capacity is limited to the number of beds provided (twin sleeps 1; double, queen, and king sleep 2 each). Extra guests beyond maximum capacity are not allowed without advance written permission. Each additional unauthorized guest will incur a charge of 10% of the nightly rental rate, per guest. No pets, smoking, or parties are allowed.
Rules, Regulations, & Other
All payments are nonrefundable. If a reservation is canceled, all payments will be forfeited. A cancelation waiver is available for purchase as described above; if purchased, funds will be refunded minus the waiver cost when canceling at least 48 hours prior to check-in.
No Tolerance Policy: Excessive noise, parties, or disturbing neighbors is strictly prohibited and will be enforced.
Reservations
All reservations are subject to management and property owner approval. Online rates are subject to change without notice. If there are any issues with your reservation, you will be contacted within 48 hours.
Property
Guest rents, for vacation purposes only, the furnished real property and improvements described in the reservation.
Arrival & Departure
Check-in is no earlier than 4:00 PM on the arrival date. Check-out is no later than 10:00 AM on the departure date. Early check-in and late check-out may be available for an additional fee (not during peak times) and must be confirmed by email.
Payments
All payments are nonrefundable. Outside 60 days of arrival, the deposit is due to reserve. The balance is due 60 days before arrival and will be charged automatically to the same credit card unless otherwise arranged. Within 60 days of arrival, the total cost is due to reserve.
Cancelations & Refunds
All payments are nonrefundable. If canceled outside 60 days of arrival, the deposit is forfeited and the guest is released from the remaining balance. Cancelations with less than 60 days’ notice result in a 100% loss of all payments (less any security deposit or damage waiver). If we rebook the dates, we will credit you 75% of the recouped rent toward a future reservation. This loss can be avoided if the cancelation waiver was purchased.
Unavailability
If, for any reason beyond management’s control, the premises become unavailable, management may substitute a comparable unit or cancel this agreement and refund all payments in full.
Strict Noise Ordinance
No loud noises, music, or loud vehicles are allowed between 10:00 PM and 7:00 AM. Violations may result in fines and removal from the property.
Approved Guests and Use
The premises are for use as a personal vacation residence by approved guests only. The reserving guest is responsible for all guests using the property and may not exceed maximum occupancy at any time. Exceeding occupancy may result in immediate removal, breach of this agreement, and forfeiture of funds.
Occupancy
Approved guests are those who will occupy the premises. No unlawful activity or nuisance is permitted. Approved guests are responsible for all lost or broken items and any damages.
Security Deposit
A valid credit card on file is required. Your reservation was either charged $89.00 for a damage waiver (up to $1,500 in coverage), a deposit was collected, or a credit card hold will be taken at check-in. If damages exceed waiver coverage or deposit amount, the credit card on file will be charged for costs including damages, missing items, excessive cleaning, fines, and, if necessary, costs to remove guest from the property.
Cleaning
The premises will be delivered professionally cleaned. Excessive cleaning required due to guest use will be charged to the guest.
Pets
No pets are allowed. If an unauthorized pet is discovered, the guest will be asked to leave without refund.
No Smoking
No smoking is allowed. Guests are responsible for all damage caused by smoking including stains, burns, odors, and debris. Violations may result in immediate removal and breach of this agreement.
Condition of Premises
Upon arrival, guest shall examine the premises and immediately report in writing any nonfunctioning or damaged items. Reporting issues does not grant cancellation or refund rights.
Lost or Left Items
Management assumes no responsibility for lost, stolen, or abandoned items. A reasonable effort will be made to return found items at guest’s request for a $25 handling charge plus shipping. Items unclaimed after 30 days may be donated or sold.
Mail Services
Guests may ship to the home using FedEx or UPS during their stay; delivery and security are not guaranteed and must be arranged between shipper and receiver. We are not responsible for lost, damaged, or delayed deliveries. Returning late deliveries after departure will incur an additional fee plus shipping.
Maximum Occupancy
Occupancy may not exceed the maximum specified in the rental agreement. Breach will result in immediate termination with forfeiture of all rental amounts and/or security deposit.
No Parties
All rentals are in residential areas and may not be used for weddings, receptions, parties, or large gatherings. Disruptive events may result in eviction and forfeiture of all funds.
Illegal Substances
No illegal substances are allowed; minors may not possess alcohol. Violations will result in eviction without refund.
TV/Cable/Internet/Satellite
No refunds are given for outages, content, lack of content, personal preferences, or device limitations. These services are a convenience and not integral to this agreement.
Air Conditioning/Heating
If equipped, guest agrees A/C will not be set below 72°F, heat not above 78°F, and fan set to “Auto.” Doors and windows must remain closed when in use. No refunds for lack or malfunction of HVAC.
Pool and Spa
If equipped, spa heating is included. Pool heating (unless solar) is an additional fee and must be paid prior to use; do not tamper with controls. Pool heat shall not exceed 86°F. Guest is responsible for damages due to misuse or negligence. Pool and spa areas may not be fenced or secure; use at your own risk.
System(s) Failures
In the event of a system failure (water, sewer, electrical, gas, plumbing, mechanical, appliances, HVAC, pool/hot tub, or structural systems), owner/management is not liable for damages and no refunds will be given. Management will make reasonable efforts to repair or replace and requires reasonable access to do so.
Unforeseen Occurrences
Management is not liable for loss, damage, or inconvenience caused by weather, natural disasters, pests, construction, acts of God, or other reasons beyond its control. No refunds are available in such instances. Travel/rental insurance is recommended.
Rules; Regulations: No Commercial Use
- Do not disturb, annoy, endanger, or interfere with other guests or neighbors.
- No commercial or unlawful use, including activities involving illicit drugs or contraband.
- Do not violate any law or ordinance.
- Do not commit waste or nuisance on or about the premises.
Maintenance & Reporting
Guest shall properly use, operate, and safeguard the premises and all items within. Immediately notify management of any problem, malfunction, or damage. Guest pays for repairs/replacements caused by guest (excluding ordinary wear and tear) and for damages resulting from failure to report issues promptly.
Entry
Management and its agents may enter the premises at any time for necessary or agreed repairs, maintenance, or to supply services; to verify compliance; or in an emergency. With at least 24 hours’ notice, management may show the premises to prospective or actual purchasers, tenants, mortgagees, lenders, appraisers, or contractors.
Parking
During winter, driveway snow removal is provided, but delays may occur during severe storms. Obey parking laws; do not park on the street where prohibited (tickets/towing may occur). Some HOAs prohibit street parking in all seasons.
Termination of Occupancy
Upon termination, guest shall return all keys/opening devices; vacate the premises by the agreed time; vacate any parking/storage spaces; and deliver the premises in the same condition (less ordinary wear and tear) as upon arrival.
Weather/Mother Nature
We cannot be responsible for circumstances beyond our control, including construction or event noise, wildfires/smoke, weather interruptions, road closures, lack of snow, frozen pipes, utility interruptions, or appliance breakdowns. Ski access descriptions are weather-dependent and not guaranteed.
Personal Property and Injury
- Owner Insurance: Guest personal property (including vehicles) is not insured by owner or HOA against loss/damage from fire, theft, vandalism, water, or criminal/negligent acts of others. Owner/management does not insure against personal injury except as related to the condition of the premises.
- Guest Insurance: Guests are encouraged to obtain insurance for themselves, their invitees, and their personal property.
- Indemnity & Hold Harmless: Guest agrees to indemnify, defend, and hold harmless owner and management from all claims, disputes, judgments, costs, and attorney fees resulting from loss, damage, or injury to guest or invitees or their property.
Mediation
Guest agrees to mediate any dispute arising out of this agreement before resorting to arbitration or court action. Mediation fees, if any, are split equally among the parties.
Joint and Individual Obligations
If more than one guest is named, each is jointly and individually responsible for all obligations under this agreement.
Entire Contract
Time is of the essence. This agreement incorporates all prior agreements and is intended as a complete and exclusive statement of terms. If any provision is held invalid, the remainder remains enforceable. A waiver of any breach is not a continuing waiver.
Release
In consideration of the right to visit the home, guest agrees to release, to the fullest extent allowed by law, owner and its management, members, officers, associates, employees, agents, representatives, attorneys, assigns, and affiliates from all liability for any personal injury, death, property damage, or other loss sustained by guest, guest’s minor children, or anyone allowed on the property during the rental period, due to any cause whatsoever, including negligence. This release binds guest’s heirs, administrators, and executors.
